Kenya Ratifies Defence Pact Granting Immunity to French Troops

Kenya Has Ratified a Defense Deal With France, Granting Immunity To French Troops, a Move That Places France’s Military Troops and Personnel Operating in Kenya, Outside of Kenya Jurisdiction and Local Courts.

Kenya’s parliament has ratified a new defence pact with France, presented as a partnership on maritime security and free trade in the Indian and Pacific Oceans.

But beneath that language is a troubling immunity clause that shields French troops from prosecution in Kenya. In simple terms, if a French soldier violates the rights of Kenyan citizens while operating under this agreement, Kenyan authorities would have no real power to hold them accountable.

This raises serious questions about Kenya’s sovereignty and why African governments continue to sign agreements that protect foreign military personnel more than their own citizens.

🗣 Kenya’s parliament, on April 28, 2026 ratified a highly contentious 5-years “defense deal” with France, granting French troops immunity from prosecution if they commit any crimes in Kenya.

🗣The 5-year “defense deal” with France was first signed by the Kenyan government and the French Ambassador, Arnuad Suquet, on October 29, 2025.

🗣The signed “defense deal,” now ratified by Kenyan parliament, renews automatically and cannot be reviewed until 2036.

🗣The “defense deal,” which grants French troops immunity from every and any crimes they commit in Kenya, takes effect weeks after 800 French troops arrived at Port of Mombasa aboard the Dixmude and Aconite warships, purportedly for a 5-month “maritime security and free-trade mission” in the Indian and Pacific Oceans.

🗣The “defense deal” effectively limits Kenya’s legal authority over foreign troops on its soil, raising broader questions around Kenya’s sovereignty, French troops accountability, and the terms under which such “defense deals and partnerships” are negotiated.

🗣The “defense deal” also comes after France disinvited and replaced South Africa from the G7 2026 summit meeting, in favor of Kenya. The 2026 G7 summit meeting will take place in Évian-les-Bains, France.

🗣When considering the implications of granting immunity to French troops in Kenya, it is noteworthy to remember the story of 21-years old Kenyan woman, Agnes Wanjiru, who was murdered and her lifeless body dumped into a septic tank, by a British soldier who was in Kenya for a training mission. The accuser, Robert James Purkiss, is yet to be extradited to Kenya and/or prosecuted for the murder of Ms. Wanjiru.
